N2  - The purpose of this paper is to trace and to master a moral dilemma regarding the concept of humanitarian intervention. The dilemma arises out of a conflict between a moral duty to inter-vene with forces in case of profoundly human rights abuse, and factors which challenge the intervention. To mitigate the dilemma, the establishment of an international institution which judges the legitimacy of a humanitarian intervention will be suggested hereafter. Though this institution cannot dissolve the dilemma, it leads to a shift in perspective: A credible commit-ment of the member states to protect human rights as effective as possible.
